Moscow, November 20, 2015. — The Government of Russia approved restrictions on access of foreign software while conducting state and municipal purchases and order of developing unified register of Russian programs for computers and databases (register of national software) developed by Ministry of Telecom and Mass Communications of the Russian Federation. Corresponding order was signed by Dmitry Medvedev.
According to the Governmental order №1236 customers should purchase Russian software for state and municipal needs, except cases when such software doesn’t possess required functional, technical and operational characteristics.
“Some Russian companies highly recommended themselves not only in Russia, but also on global market. State support of developers is among our key priorities and it is established in our import-substitution plan,” said Nikolay Nikiforov, “Minister of Telecom and Mass Communications, “We should purchase national software at the expense of our taxpayers. Tens of billions of rubles will be annually used for development of our country and improvement of life quality of our citizens.”
Vladimir Putin signed the Federal law №188 on June 29 20145. It defines order and terms for considering Russian software and creation of register of Russian software. The law also defines basic criteria for including software products to this register. List of requirements to software products in accordance with established criteria was defined by the Governmental order.
Russian right holder should possess exclusive right on software, software should be freely handled and distributed in Russia, amount of licensed and other contributions in favor of foreign right holders should be no more than 30% from revenue from software implementation. Data on software shouldn’t contain national security information, Russian right holders should possess exclusive right on software on all term of its operating.
“Requirements for considering Russian software were widely discussed. Comments and opinions of all interested parties were taken into consideration in the final document,” noted Nikolay Nikiforov, “Russian IT products can successfully compete with import analogues. They will get additional support due to internal demand. It’s a special signal for improvement of existing solutions taking into consideration real demands of customers. We are standing for localization of development centers, competences and revenue in Russia.”
Requirements of customers to functional, technical and operating characteristics should be justified taking into consideration general rules for defining requirements to software purchased for state and municipal needs. These rules will be developed by Minsvyaz, interested Federal authorities and organizations in a three month term.
Minsvyaz will also approve software classifier in a two month term. It will contain characteristics for defining type of software and rules for its application. It will also establish correspondence of each software type to codes of the National Classification of Economic Activities.
Special Expert Council under Minsvyaz will be established for conducting of expertise for including data on software to the register. It will consist of representatives of public authorities — no more than 40% from total number of Council members, participants at suggestion of associations of Russian software developers — not less than 50% from total number of Council members, scientific and educational establishments, innovation organizations or companies supporting innovation activities. Council structure will be approved till the end of 2015.
Russian software register will be conducted by special operator, registered in Russia. It will possess right to receive obligatory copy of software in accordance with the law “On obligatory cope of documents”.
Restrictions on purchase of foreign software for state and municipal needs shouldn’t be applied to diplomatic missions, consular institutions, trade missions under international organizations for ensuring their operating on territory of foreign government.
Minsvyaz and interested parties will also coordinate topic of developing conditions for access of software from countries of the Eurasian Economic Union to state and municipal purchases. These conditions will be the same as for supplier included in the register of Russian software. This topic will be elaborated within half a year. Suggestions will be coordinated with Ministry of Economic Development and Ministry of International affairs and directed for approval to the Government of Russia.
